Terms of Use Regarding Participant Data, Technologies and Services for Participating Organizations in the People’s Climate March

  1. On September 21, 2014, the People’s Climate March (PCM) will take place in locations all around the world. We hope that the PCM will set a new standard for how a variety of diverse Participating Organizations can effectively collaborate to address the most pressing problems facing our planet. These Terms of Use are designed to enable Participating Organizations to uphold their privacy commitments to their members and to preserve control over their members’ data, while enabling close collaboration among Participating Organizations to maximize turnout for the PCM.
  2. Your Participating Organization may use any means at all to drive potential PCM participants to the PCM website, at www.PeoplesClimate.org. If you agree with Avaaz and 350 to use a special tracking code, we will be able to track precisely which users your organization drives to the site. You can also use paper materials to collect participant data from in-person events (please contact Avaaz for more details). Your organization can provide your members’ data that will be uploaded to the Voter Action Network (VAN) database, and then used by PCM staff to drive turnout to the PCM. We’ll also use Mobile Commons as a tool to drive turnout with SMS (text) messages to phones. Please contact Andrew.Nazdin {at} avaaz {dot} org if you are ready to upload your data to the database.
  3. Your Participating Organization’s data will never be sold, and it will never be used by anyone other than your Participating Organization, and Avaaz and 350 as administrators. Volunteers or organizations approved by Avaaz and 350.org will have access to individual records for the purpose of contacting them and indicating their responses to raise turnout to the PCM. Such volunteers and organizations will not have the ability to export, save or otherwise download your Participating Organization’s data.
  4. People’s Climate March staff will use the information in the database to turn out as many people as possible to the People’s Climate March – they’ll use the data to send emails and make telephone calls. None of these communications will involve fundraising appeals. If you would like your Participating Organization’s trademark or symbol used in these communications, please contact DavidSievers {at} avaaz {dot} org and John.Tye {at} avaaz {dot} org.
  5. Your Participating Organization can get all its data back from the database after the PCM, if you request, including any participants that you send to the database. We’ll use tracking codes to determine which organizations each participant is affiliated with. Please contact DavidSievers {at} avaaz {dot} org if you are interested in this option.
  6. Your Participating Organization can have all its data deleted from the database after the PCM, if it wants. Please contact DavidSievers {at} avaaz {dot} org if you are interested in this option.
  7. After the PCM, whichever records are not deleted from the database will be put into a “receivership” with a trusted organization, Alliance for a Greater New York (ALIGN), that will not use the data for any purpose. Every organization that allows at least 100 records to stay in the database will be on the receivership committee, which will decide by unanimous consent what to do with the undeleted records. This means that the data will just sit there, securely encrypted, unless everyone agrees how it should be used. If the receivership committee does not decide to do anything with this data, it will be destroyed on January 1, 2016.
  8. Avaaz, 350.org and their partners or subcontractors shall use all commercially reasonable technological standards to secure the data in the VAN database.
  9. These Terms of Use have been created by Avaaz Foundation (“Avaaz”) and 350.org (“350”), and will apply to any Participating Organization that does not have a separate Memorandum of Understanding with Avaaz and/or 350. Please note that if your Participating Organization requires different policies or more detail than those laid out in these Terms of Use, then Avaaz and 350.org are happy to alter the terms and sign a separate Memorandum of Understanding with your organization. Unless your organization has a separately-signed MOU with Avaaz, these Terms of Use will guide our interactions.
  10. [This clarification added September 18, 2014] Data collected from the PCM website starting on September 21, the day of the March, will be treated slightly differently: it will be stored temporarily in 350.org’s database, before it is transferred into the VAN database. All of the same tags will be preserved, and participating organizations will still have the option to delete records with their tags. This temporary redirection is necessary because on the day of the March, the New York City and global PCM pages will be combined into one page displaying photos from marches all around the world. For technical reasons, it is easiest to temporarily store signups from the day of the march and beyond in the 350.org database. These signups will not be added to 350.org communications or emails.
